Terms of Service
Effective date: October 26, 2026
These Terms of Service (“Terms”) govern access to and use of buyerscollection.com and the Buyers Collection application (the “Service”), operated by Steve Fill as Buyers Collection (“Buyers Collection,” “we,” “us”) in Fort Lauderdale, Florida. By creating an account, accepting an invitation or using the Service, you agree to these Terms and to our Privacy Policy.
1. Eligibility and approval
The Service is for yacht brokerages, boat dealerships and boat builders (each a “Company”) and their authorized team members. The person who creates a Company account must be an owner, manager or authorized representative and confirms they may bind the Company to these Terms. Every Company account is reviewed. We may approve, request more information, decline, suspend or deactivate any account at our discretion.
2. Evaluation and activated access
An approved Company that has not activated membership receives an Evaluation Workspace with fictional sample data stored only in the user’s browser. Evaluation access does not include production data, other members, Smart Matches, messages or emails. Production workspace access is provided only after membership is activated. Read-only access may apply in certain billing situations.
3. Company administrators and seats
Company owners and managers may invite and remove team members within the Company’s seat allowance and are responsible for who they invite. Each seat is for one named person and may not be shared. The Company is responsible for its team members’ use of the Service.
4. Account security
Keep your sign-in credentials confidential, use a strong password and notify us promptly at support@buyerscollection.com of any unauthorized use. You are responsible for activity under your account.
5. Buyer confidentiality — no buyer personal information
Buyer Profiles describe what a represented buyer wants. Client names and contact details may be entered only in the private Client section, never in Buyer Profile or Listing details, notes or messages. You must have authority from your client to share their criteria. Members connect broker-to-broker; you will not attempt to contact another member’s buyer directly or circumvent the representing broker.
6. Your content
You are responsible for the content you submit, including its accuracy and your right to share it. You keep ownership of your content and grant Buyers Collection a non-exclusive license to host, process, display to authorized members and use it to operate and improve the Service. We may remove content that violates these Terms.
7. Acceptable use
You will not: scrape, copy, export in bulk or resell data from the Service; share access or member information with non-members; misrepresent listings, buyers or yourself; harass or spam other members; attempt to access data you are not permitted to see or bypass security or seat limits; reverse engineer or interfere with the Service; or use the Service unlawfully.
8. No guarantee of outcomes
Buyers Collection is a connection tool. We do not act as a broker, dealer or party to any transaction and do not verify listings or buyer criteria. We do not guarantee any match, introduction, listing, sale, commission or other outcome, or the accuracy of member content. Members are solely responsible for their own dealings, agreements and compliance with law and licensing rules.
9. Smart Matches and notifications
Smart Matches are generated automatically from the criteria members enter and may be incomplete or imperfect. Match and notification emails may be delayed, filtered or not delivered. Do not rely on them as the only means of tracking opportunities.
10. Membership, fees and billing
Membership fees, seat pricing, term, renewal, payment and refund terms are set out in the order form, invoice or other written agreement provided to your Company (“Commercial Terms”). If Commercial Terms conflict with these Terms on those subjects, the Commercial Terms control. Unless the Commercial Terms say otherwise, fees are non-refundable, and if payment is not received, access may become read-only or be suspended.
11. Intellectual property and feedback
The Service, including its software, design and branding, belongs to Buyers Collection. These Terms give you a limited, non-transferable right to use the Service during your membership. If you send us feedback or suggestions, we may use them without obligation to you.
12. Third-party services
The Service relies on third-party hosting, authentication and email providers. We are not responsible for third-party services or websites linked from the Service.
13. Suspension and termination
We may suspend or terminate access for violation of these Terms, non-payment, risk to other members or the Service, or as required by law. A Company may stop using the Service at any time; fees are governed by the Commercial Terms. Sections that by their nature should survive termination will survive.
14. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT AND THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE.
15. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, BUYERS COLLECTION WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, COMMISSIONS, DEALS OR DATA. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE FEES YOUR COMPANY PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM.
16. Indemnification
You and your Company will defend, indemnify and hold harmless Buyers Collection from claims, losses and expenses (including reasonable attorneys’ fees) arising from your content, your use of the Service, your dealings with other members or buyers, or your violation of these Terms or law.
17. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules. Any dispute will be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to their jurisdiction.
18. Changes
We may update these Terms. We will post the updated version with a new effective date and, for material changes, give notice and may ask you to accept the new version. Continued use after the effective date means you accept the updated Terms.
